Terms of Service
Effective Date: January 1, 2026
These Terms of Service (“Terms”) govern your access to and use of the 713FlatFeeMLS website at 713flatfeemls.com and all related services (collectively, the “Platform”), operated by 713FlatFeeMLS, a licensed Texas real estate brokerage (“713FlatFeeMLS,” “we,” “our,” or “us”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Acceptance of Terms
By accessing the Platform, creating an account, submitting a listing, requesting a CMA, or requesting a cash offer, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and agree to comply with these Terms and all applicable federal, state, and local laws.
We reserve the right to modify these Terms at any time. Updated Terms will be posted to this page with a revised effective date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
2. Services Provided
713FlatFeeMLS provides the following services through its Platform:
- Flat Fee MLS Listing: Submission and management of real estate listings to the Houston Association of Realtors (HAR) Multiple Listing Service and affiliated portals (Zillow, Realtor.com, Redfin, etc.) for a flat fee paid upfront.
- Cash Offer Facilitation: Collection and presentation of your property information to a network of vetted cash buyers who may submit purchase offers. 713FlatFeeMLS acts as a facilitator, not a purchaser, unless otherwise expressly stated.
- AI Pricing Tools: Automated home valuation tools powered by machine learning that analyze comparable sales, market trends, and property data to suggest a list price or estimated home value.
- Seller Dashboard: An online interface providing real-time visibility into your listing status, showing activity, offer management tools, and document storage.
- Comparative Market Analysis (CMA): Free, non-binding professional assessments of estimated home value based on recent comparable sales and market data.
All real estate brokerage services are provided by Ty Anderson, a licensed Texas real estate broker (TREC License). 713FlatFeeMLS is not a law firm and does not provide legal advice. For legal questions related to your real estate transaction, consult a licensed Texas real estate attorney.
3. User Accounts and Responsibilities
To access certain features of the Platform (including the Seller Dashboard and listing management tools), you must create an account. When creating an account, you agree to:
- Provide accurate, current, and complete information.
- Maintain the security of your password and account credentials.
- Notify us immediately of any unauthorized access to your account.
- Accept responsibility for all activity that occurs under your account.
You may not share your account with others, use another person's account, or create multiple accounts for the same property without authorization. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Payment Terms
All listing packages require full payment of the flat fee upfront before your listing is submitted to the MLS. Fees are as follows:
- Standard Plan: $399 (6-month listing)
- Booster Plan: $599 (12-month listing)
- Premium Plan: $799 (12-month listing)
Flat fees are non-refundable once your listing is live on the MLS. If we fail to submit your listing to the HAR MLS within 48 hours of receiving all required listing information and payment, you are entitled to a full refund upon written request.
Buyer's agent compensation (typically 2.5-3% of the sale price) is negotiated separately and is not included in the flat fee. You agree to clearly specify buyer's agent compensation in your listing as required by HAR MLS rules and applicable law.
Add-on services (professional photography, virtual tours, yard signs, etc.) are priced separately and are subject to the same non-refundable policy once services have been rendered or scheduled.
5. Listing Rules and Seller Obligations
As the seller and listing party, you are responsible for the accuracy and completeness of all information submitted for your listing. You agree to:
- Provide accurate property information including address, square footage, bedroom and bathroom counts, year built, lot size, and current condition.
- Disclose all material facts about the property as required by Texas law, including known defects, flood history, and any other required seller disclosures.
- Comply with all HAR MLS rules, including rules regarding listing content, photography standards, and buyer's agent compensation disclosure.
- Not submit false, misleading, or fraudulent information about the property.
- Not include contact information (phone numbers, email addresses, URLs) in the public remarks of your MLS listing, as prohibited by HAR MLS rules.
- Promptly update your listing when material information changes (price reductions, status changes, accepted offers).
You acknowledge that any violation of HAR MLS rules or Texas real estate law is your sole responsibility. 713FlatFeeMLS reserves the right to remove listings that violate MLS rules or applicable law without refund.
6. Intellectual Property
All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, images, software, AI pricing algorithms, and the overall design and layout — are owned by 713FlatFeeMLS and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any portion of the Platform without our prior written consent. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform solely for your personal, non-commercial purposes in connection with selling your home.
7. Disclaimer of Warranties
THE PLATFORM AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
Specifically, you acknowledge and agree that:
- AI Pricing is an Estimate, Not a Guarantee. All AI-generated home valuations, CMAs, and pricing recommendations are estimates based on available data and algorithms. They are not appraisals and do not guarantee that your home will sell for any particular price. Actual sale prices depend on market conditions, property condition, buyer demand, and many other factors outside our control.
- We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.
- We make no representations regarding the outcome of your home sale, the number of offers you will receive, or the final sale price.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, 713FLATFEEMLS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID BY YOU TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
9. DMCA Policy
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe that content on the Platform infringes your copyright, please submit a written DMCA notice through our contact page with: (a) your name and contact information; (b) a description of the copyrighted work you claim has been infringed; (c) the URL or location of the allegedly infringing content; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
10. Indemnification
You agree to indemnify, defend, and hold harmless 713FlatFeeMLS, its broker, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) any inaccurate or misleading information you provided in your listing; (d) your violation of any third-party rights, including HAR MLS rules; or (e) any claims arising from your real estate transaction.
11. Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration administered by JAMS under its Streamlined Arbitration Rules, with proceedings conducted in Harris County, Texas. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in the state or federal courts located in Harris County, Texas, to prevent irreparable harm pending resolution of a dispute. You waive any right to a jury trial and any right to participate in a class action lawsuit.
12. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include violation of these Terms, submission of false listing information, non-payment, or activities that harm other users or the Platform. Upon termination, your right to use the Platform ceases immediately. Sections 6 (Intellectual Property), 7 (Disclaimer of Warranties), 8 (Limitation of Liability), 10 (Indemnification), and 11 (Dispute Resolution) shall survive termination.
